It governs the collection, use, communication, storage and destruction of personal data. <strong>personal information<\/strong> (within the meaning of the Act respecting the protection of personal information in the private sector). Your obligations with regard to transparency and the publication of a Web policy are set out in our Internal Guide (see section <em>Policies and procedures<\/em>).<\/p><p><strong>2) Key definitions<\/strong><\/p><ul><li><strong>Personal information<\/strong> Personal data: any information concerning a natural person that enables that person to be identified directly or indirectly (e.g., identity, personal details, financial data, health information, etc.). Contact details <strong>strictly professional<\/strong> (name, title, business address\/email\/telephone) are not covered.<\/li><li><strong>Sensitive personal information<\/strong> : information generating <strong>high expectation of privacy<\/strong> (e.g. health, finance, biometrics, political opinions, etc.) - a <strong>express consent<\/strong> is then required.<\/li><\/ul><p><strong>3) What information do we collect?<\/strong><\/p><p>Depending on the context, we can collect :<\/p><ul><li><strong>Users of the Sites and persons who communicate with us<\/strong> name, contact details (e-mail, telephone), content of your requests, <strong>navigation data<\/strong> (IP address, pages viewed, date\/time, type of device and browser) and <strong>cookies<\/strong> and similar technologies for analytics and service improvement.<\/li><li><strong>Customers (B2B)<\/strong> contact information, language, billing and payment information, communication preferences and more, <strong>if applicable<\/strong>, information from customer environments <strong>strictly necessary<\/strong> implementation, support and enhancement of our software. When our teams need to <strong>diagnose an application incident<\/strong>, a <strong>controlled copy<\/strong> from a customer database may be temporarily processed; in this case, we process <strong>all<\/strong> personal information such as <strong>confidential<\/strong>, we apply <strong>appropriate safety measures<\/strong> and strictly limit access.<\/li><li><strong>Applicants\/Employees<\/strong> Information required for recruitment or HR management purposes (e.g. identity, contact details, career path, SIN, bank details, emergency contact), as required by law. (Minimum legal retention periods apply, e.g. certain employee files must be kept for a certain period of time. <strong>7 years<\/strong>.)<\/li><\/ul><p><strong>4) Purpose of use<\/strong><\/p><p>We use personal information to :<\/p><ul><li><strong>Supply<\/strong> our products and services, manage accounts and customer relations, run and improve our software (including support\/maintenance).<\/li><li><strong>Reply<\/strong> to your requests and provide customer service.<\/li><li><strong>Secure<\/strong> our solutions and environments (incident prevention\/detection, improving our safety measures).<\/li><li><strong>Analyze<\/strong> the use of the Sites and improve the experience (aggregated statistics and <strong>depersonalized<\/strong>).<\/li><li><strong>Communicate<\/strong> with you (e.g. newsletters, offers), <strong>with your consent<\/strong> when required and can be withdrawn at any time.<\/li><\/ul><p><strong>5) Consent (including minors) and validity<\/strong><\/p><p>We are looking for a <strong>valid consent<\/strong> (manifest, free, informed, specific, distinct, comprehensible and <strong>temporary<\/strong>), and <strong>express<\/strong> when the information is <strong>sensitive<\/strong>. The consent of <strong>under 14<\/strong> must be given by a parent or guardian (14 years and over: by the minor, his\/her parent or guardian). You can also <strong>withdraw your consent<\/strong> at any time, subject to applicable legal requirements.<\/p><p><strong>6) Identification, location or profiling technologies (cookies)<\/strong><\/p><p>Our Sites use <strong>witnesses<\/strong> and similar technologies (e.g., analytical): a <strong>cookie management banner<\/strong> allows you to accept, decline or customize your choices; you can change your preferences at any time. We do not activate profiling functions by default, and we provide information on how to activate them.<\/p><p><strong>Typical witness categories<\/strong><\/p><ul><li><strong>Essentials<\/strong> (safety, accessibility, sessions)<\/li><li><strong>Analytics\/Performance<\/strong> (aggregated usage statistics)<\/li><li><strong>Personalization<\/strong> (preferences)<\/li><li><strong>Marketing<\/strong> (if applicable, with consent)<\/li><\/ul><p><strong>7) Communications to third parties and\u00ab<\/strong><strong>\u202f<\/strong><strong>service providers<\/strong><strong>\u202f<\/strong><strong>\u00bb<\/strong><\/p><p>We may disclose information :<\/p><ul><li>To our <strong>service providers<\/strong> (hosting, IT, support, payment processing, etc.) <strong>only<\/strong> for the purposes described, with <strong>written obligations<\/strong> confidentiality, security and deletion at the end of the mandate, in accordance with section 18.3 of the Act (contractual clauses required).<\/li><li>As part of a <strong>business transaction<\/strong> (merger, financing, sale of assets), subject to confidentiality undertakings and limited use for the purposes of the transaction; notice will be given after completion, where applicable.<\/li><li>To comply with <strong>legal obligation<\/strong> or respond to a competent authority.<\/li><\/ul><p><strong>Important (B2B\/support relationship).<\/strong> When <strong>exceptional<\/strong>, we need to access environments or obtain a <strong>controlled copy<\/strong> customer's database for implementation or support purposes, we will <strong>treat this data as confidential<\/strong>, we apply <strong>proportionate safety measures<\/strong> and <strong>limit conservation<\/strong> to the strict minimum.<\/p><p><strong>8) Accommodations, transfers outside Quebec and PIAs<\/strong><\/p><p>Our solutions are designed to <strong>minimize<\/strong> the circulation of personal data outside our customers' environments. All <strong>transfer outside Quebec<\/strong>, if it occurs, will be the subject of a <strong>Privacy Impact Assessment (PIA)<\/strong> and\u2019<strong>agreements<\/strong> ensuring <strong>adequate protection<\/strong> (contractual and legal measures) <strong>before<\/strong> communication.<\/p><p><strong>9) Safety measures<\/strong><\/p><p>We set up <strong>technical, organizational and physical measures<\/strong> proportionate to the sensitivity, purpose, quantity and medium of the information (e.g. access control, appropriate encryption, identity management, employee training and commitment to confidentiality, logging, secure retention\/destruction practices). As no mechanism offers absolute security, we are constantly improving our systems.<\/p><p><strong>10) Retention, anonymization and destruction<\/strong><\/p><p>We store information <strong>only<\/strong> purposes and to comply with our legal obligations, and then we disclose them to <strong>destroy<\/strong> safety or the <strong>anonymize<\/strong> if a serious and legitimate use requires it. As a guide, certain categories (e.g. employee files) have minimum retention periods (e.g. 7 years). Internal written procedures govern retention and destruction.<\/p><p><strong>11) Automated decisions and profiles<\/strong><\/p><p>We <strong>let's not<\/strong>, decisions to date <strong>based exclusively on<\/strong> on automated processing with significant legal effects for you. Should this change, we will provide the required information (information used, main factors\/parameters, right to rectification). <strong>before<\/strong> implementation.<\/p><p><strong>12) Your rights<\/strong><\/p><p>In particular, you have the following rights:<\/p><ul><li><strong>Information<\/strong> on processing (purposes, means, internal access, categories of recipients, transfers outside Quebec, retention period, contact details of the PRP Manager).<\/li><li><strong>Access<\/strong> and <strong>copy<\/strong> of your information;<\/li><li><strong>Rectification<\/strong> any inaccurate, incomplete or ambiguous information;<\/li><li><strong>Withdrawal of consent<\/strong> (where applicable);<\/li><li><strong>Cessation of distribution \/ dereferencing \/ reindexing<\/strong> in cases provided for by law;<\/li><li><strong>Portability<\/strong> information <strong>computerized<\/strong> that you have provided to us (right in force since September 22, 2024), in a technological format <strong>structured and widely used<\/strong>, and direct transmission to a legally authorized organization whenever possible.<\/li><\/ul><p><strong>How to exercise your rights<\/strong> Send a written and dated request to <strong>Privacy Officer<\/strong> (contact details in section 14). We may verify your identity, ask for details to locate the data and, if necessary, claim compensation. <strong>reasonable costs<\/strong> for reproduction\/transmission (advance notice).
